For over 30 years, Section 340B of the federal Public Health Act has required drug manufacturers to offer a discounted ceiling price on outpatient prescription drugs to qualifying covered entities and has provided savings essential to reliable and sustainable funding. However, the 340B program faces ever-changing and increasing challenges from manufacturers, prescription benefit managers, and others, while at the same time certain judicial and legislative actions at the state and federal levels signal the potential for increased protections and expanded eligibility for the use of 340B drugs for patients.
