Understanding the No Surprises Act

The No Surprises Act aims to reduce the occurrence of surprise bills and introduce greater transparency in communicating with patients about the price of health care services. One provision of No Surprises requires providers and facilities, effective January 1, 2022, to furnish a written “good-faith estimate” (GFE) of the cost of services to uninsured or self-pay patients, inclusive of any discounts available to such patients, at the time the patient schedules services or requests an estimate.The GFE requirement has been implemented amidst a new surge in COVID-19 cases and, for many providers, an unprecedented staffing shortage.

This webinar will address common questions that providers and facilities have encountered in their first month of furnishing GFEs to uninsured and self-pay patients. We will address, for example,

  • The interaction between the GFE and discounts some providers offer to uninsured or self-pay patients
  • GFEs for “underinsured” patients (e.g., patients who have high deductibles or only partial coverage)
  • GFEs involving referral providers, laboratories or radiological facilities
  • GFEs for complex services

We will also summarize December 2021 HHS guidance on good-faith estimates.
