Back-to-school season provides an ideal opportunity to review the federal laws and regulations that apply to records maintained on students, identify the key compliance risk areas for health centers as they use, disclose and request such records, and develop strategies to minimize identified compliance risks.  As covered entities, most health centers and their staff members are familiar with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) Rules, including the HIPAA Privacy Rule which requires covered entities to limit the uses and disclosures of protected health information permitted without patient authorization.  The Family Educational Rights and Privacy Act (FERPA) statute and implementing regulations protect students’ education records, providing parents with the right to access, to amend, and to consent to the disclosure of personally identifiable information from their child’s education records.

As health centers partner with schools to provide health care, to coordinate support services and to assist families and the community, it is critical to ensure information is appropriately used and disclosed to avoid non-compliance and to build trust with students and their families.  Understanding the regulatory framework can also improve communication between health center and school staff members, as each party better understands when student health information can be disclosed and when additional consent is required.  In this webinar, we will review how HIPAA and FERPA apply to and typically affect health centers, recommend key policies and procedures to review and revise for compliance, and discuss training priorities for staff members working with and in schools.
