(Recorded Webinar) Best Strategies for Head Start Organizations to Avoid the Legal Challenges of Remote Work Arrangements
The COVID-19 pandemic forever changed the workplace as many Head Start organizations were forced to abruptly transition from the conventional “in office” model to one in which staff, consultants, and contractors worked remotely from home. Now, after nearly two years of working remotely, Head Start organizations are increasingly reopening and offering some of their personnel the option of working from home on a part-time or, in some cases, a full-time basis.
Given this new and unprecedented reality, organizations must contemplate and resolve a myriad of legal considerations and obligations that specifically pertain to remote-work arrangements, such as:
- How do we ensure that we are satisfying the FLSA’s overtime pay requirements for nonexempt remote working personnel?
- Are we responsible for injuries sustained by personnel who are injured while working from home?
- Do we have a responsibility under OSHA to ensure that a remote home workplace is free from hazards that are likely to cause harm?
- What accommodations, if any, do we have to make under the ADA for personnel who work at home?
- Will we potentially face liability under Title VII if we do not uniformly offer remote work arrangements to personnel?
- How do we protect confidential and sensitive business information from others who may reside with an employee?
In this training, FTLF will help Head Start organizations identify and navigate some of the common legal issues that arise with a remote workforce by examining the best practices for devising and implementing a successful Remote Work Program. We will discuss the “must-have” policies that every Head Start organization should have in place in order to ensure they have the requisite strategies for sustaining long-term remote operations. And, we will examine why organizations should use Remote Work Agreements to limit potential liabilities, increase productivity, and manage remote work arrangements.
