PPP Update: Assessing Your Loan

May 12, 2020

Access the on-demand webinar here.

This webinar is an update to our May 5 webinar, Protecting Against Future PPP Loan Investigations.

The Small Business Administration (SBA) has received a total of $670 billion for its Paycheck Protection Program (PPP), serving as a key source of potential federal support for small businesses and nonprofits.

Businesses receiving PPP loans are required to make a number of certifications regarding the necessity for the loan, eligibility of the business, amount of the loan requested, and use of the loan proceeds. Recent guidance from the SBA reminded borrowers to “review carefully the required certification that ‘[c]urrent economic uncertainty makes this loan request necessary to support the ongoing operations of the Applicant’” and provided an amnesty period for ineligible borrowers to repay the loan without penalty (read our original Client Alert here).

The original deadline of May 7, 2020 was extended and borrowers now have until May 14, 2020 to repay the loan without penalty.

On our last webinar, we talked about the potential risks and enforcement actions that may stem from PPP loans. Given the high demand, and near daily updates by the SBA, we are hosting a new webinar to discuss:

  • New guidance from the SBA
  • Best practices for assessing need
  • Answers to your questions about applying for the funds, using the funds, and seeking forgiveness

Target Audience

  • CEOs/Program Directors
  • In-house legal counsel
  • CFOs and Fiscal Staff
  • Compliance Officers and Staff
  • Outside counsel

Learning Objectives

After this webinar, you will be able to:

  • Describe any updates that the SBA has issued
  • Explain how non-SBA grants may factor into the SBA need-based calculation
  • Discuss the questions that the government will ask in an audit/investigation
  • Identify strategies to assess compliance now and create necessary documentation in the event of a later audit/investigation
