Many health centers and their staff members rely on the professional liability coverage offered pursuant to the Health Center Federal Tort Claims Act (FTCA) program. From submitting the initial application for “deeming” status to handling malpractice claims and preparing for a site visit, FTCA program compliance is essential.

FTCA coverage depends upon whether the services provided are:

  • Within the health center’s 330 approved scope of project?
  • Within the scope of employment?
  • Provided to health center patients?

The answers to these questions are not simple. They often require legal analysis, interpretation of HRSA guidance, and detailed understanding of medical malpractice. Failing to comply with the FTCA program requirements can be very costly for health centers and providers who can be left without any professional liability insurance for very expensive claims.

FTLF's attorneys will discuss the biggest risks in FTCA coverage for health centers, including risks related to:

  • FTCA applications and participation (either deeming or redeeming)
  • Common concerns around FTCA coverage
  • Current FTCA "hot issues" that health centers across the country face in the ever-changing healthcare environment

This session will also cover substantive changes in the FTCA program such as the addition of FTCA coverage for volunteers, as well as the significant changes made to the deeming application to bring it into alignment with the Health Center Compliance Manual.

The deeming application process is fraught with challenges. Knowing how to complete a deeming application by providing the information that reviewers will be looking for will go a long way toward making the application process less stressful and more effective.

Since its inception in 1992, there have been a number of important cases decided by federal courts that directly affect the FTCA program. In this workshop, we will review the most important cases and their implications for your health center.

Matt Freedus is a Partner with the firm and represents health centers facing a variety of adverse administrative decisions and legal actions. Defending clients in all phases of administrative and judicial review, from the lowest level up to the Supreme Court, he also represents clients in affirmative litigation against states and other entities. We accept payment by PayPal, credit card, and check. Payment for any live training is due upon registration. If payment is not received in full prior to the start of the event, FTLF reserves the right to cancel your order and deny you entrance to the training.


Cancellation/Transfer Policy

All cancellation or transfer requests must be received in writing at learning@ftlf.com. Requests for refunds or transfers for in-person events will be granted according to the following schedule:

  • 45 or more days prior to the event, requests for a full refund or a transfer, minus a $75 administrative fee, will be granted.
  • Between 15 to 44 days prior to the event, requests for cancellations will be granted, subject to an administrative fee equal to 50% of the paid registration fee. Requests for transfers may be granted, space permitting and subject to a transfer fee.
  • Within 14 days of the event start date, no requests for refunds or credits will be granted. At FTLF's discretion, late transfers may be granted, space permitting and subject to a transfer fee.

Cancellation of a registration with group pricing may result in the discount being revoked or reduced for the entire group.

Can I transfer from in-person to the virtual classroom? 

Yes, you can transfer from attending in-person to virtually.  Please note that no refunds of the price difference, if any, will be given.  Within 45 days of the event start date, transfers from in-person to virtually will be subject to a transfer fee. Within 14 days of the event start date, no transfers from in-person to virtual will be permitted. All transfer requests must be submitted in writing.  

Can I transfer from the virtual classroom to attend in-person?

Yes, you can transfer to attend in-person, providing there is an open seat.  Any additional registration cost is due at the time of transfer.  All transfer requests must be submitted in writing.
