The COVID-19 pandemic forever changed the workplace as businesses were forced to abruptly transition from the conventional “in office” model to one in which many employees worked remotely from home offices. Now, nearly two years later, many offices have yet to fully reopen, and it appears that the “new” normal will consist of employees who either work full-time from home or only come into the office on a part-time basis.

In order to adequately manage remote working arrangements and to mitigate any potential liabilities that may arise from the above legal issues, employers should conduct a thorough and comprehensive audit of their existing policies and practices to ensure that they have the requisite strategies in place for sustaining long-term remote operations.

In this training, FTLF will help you identify and navigate some of the more common legal issues that arise with a remote workforce by walking you through the best practices and some of the “must have” policies that you should have in place. We will also discuss how you can use Remote Work Agreements to limit your potential liabilities, increase productivity, and effectively manage your remote work arrangements with your employees.

  • Develop a comprehensive remote work/telework program that minimizes liability and risk

  • Explain the importance of Remote Work Agreements in effectively managing remote working employees and draft Remote Work Agreements for your organization
  • Understand compliance obligations under federal employment statutes such as Title VII, the FLSA, and the ADA
  • Identify best practices for securing and protecting the company’s confidential information and data
  • Effectively manage remote employees on issues such as performance evaluation, supervision, attendance, and discipline
  • Understand obligations under OSHA to provide a safe home workplace for remote workers as well as how to limit potential exposure to workers’ compensation claims
