Many employers have a difficult time understanding their compliance obligations under the Americans with Disabilities Act (ADA). While organizations generally understand that the ADA requires an employer to provide a reasonable accommodation to qualified individuals with disabilities who are employees or applicants for employment, they don’t truly grasp the fundamental requirements of the ADA, such as:

  • Does the ADA apply to my organization?
  • Who is a “qualified individual with a disability” under the ADA?
  • What constitutes a “reasonable accommodation” under the ADA?
  • Can I require an employee who is requesting an accommodation under the ADA to provide documentary “proof” of their disability from a physician?
  • Am I obligated to provide a qualified individual with a disability with their preferred accommodation?
  • How can I discipline or terminate a disabled employee who is having performance issues without violating the ADA?
  • Do I have to hire someone with a disability if they apply for a job?
  • Can I ask a job applicant to tell me about their disability and, if so, what questions are permissible under the ADA?
