The challenge to the 340B contract pharmacy model that some drug manufacturers commenced last year has led to numerous lawsuits, that are slowly winding their way through federal courts. Health centers have sued the Department of Health and Human Services over HRSA’s near ten-year delay in implementing a process to resolve disputes with manufacturers, and other 340B covered entities have sued HRSA asking it to require manufacturers to ship 340B drugs to contract pharmacies. Meanwhile, several drug manufacturers and the major pharmaceutical manufacturer trade association also have filed lawsuits, several of which challenge the legitimacy, and ultimately the viability of, the contract pharmacy model itself.

In this webinar, FTLF Partners Michael Glomb and Jason Reddish will explain the status of the various lawsuits, the likely next steps, the prospects for a favorable outcome, and how 340B covered entities can navigate the uncertainties.
