Individuals and entities that have been excluded are prohibited from participating in a federal health care programs.  No federal health care program payments can be made for any items or services furnished by an excluded individual or at the medical direction of an excluded individual.  Excluded individuals cannot serve in an executive or leadership role or provide administrative or management services.  Health centers cannot contract with or provide subawards to certain parties that are debarred, suspended or otherwise excluded from or ineligible for participation in federal assistance programs or activities.

Health centers are responsible for screening federal and state databases to identify excluded individuals and entities.  Common compliance challenges related to exclusion screening in health centers include:

  • Determining who should be screened: Providers? C-Suite? All employees? Board members? Volunteers? Students? Vendors/contractors?
  • Assigning responsibility for screening: Human Resources? Credentialing? Finance? Compliance?
  • Determining the frequency of screening: Upon hire? Annually? Monthly?
  • Developing a procedure for responding: Should the employee be taken off the schedule? Can the employee continue to work in some capacity?  Should the health center self-disclose the employment of an excluded individual?
