Providing Telecommunications Technology and Services to Patients

As health centers increasingly deliver telehealth services during the COVID-19 public health emergency, the use of telehealth may not be practical for patients who cannot afford a smartphone or access to an internet service plan at home. 

To address this obstacle, some private foundations, government agencies, or health plans have offered funding to health centers that may be used to purchase telecommunications devices or services.  Health centers would then provide devices or services to patients who need them to access telehealth services. 

At the same time, the Office of Inspector General (OIG) of the U.S. Department of Health and Human Services has asserted that the provision of technology and data services to Medicare and Medicaid beneficiaries by providers implicates the Beneficiary Inducement Prohibition and Anti-Kickback Statute under federal law.

This webinar will explain the legal risks of providing telecommunications technology and data services to patients and how to minimize those legal risks under OIG guidance recently issued during the COVID-19 public health emergency.  The webinar will also describe additional steps that health centers should take to document compliance with current OIG guidance.
