Medical Marijuana: Health Center Compliance Amidst State Law Changes

Medical cannabis is legal in nearly 40 states, and voters in a handful of states will decide whether to legalize commercial sales of adult-use marijuana in the upcoming November midterm elections.   Despite this sea change at the state level, health centers are still bound by the federal law prohibition on marijuana under the Controlled Substances Act.  This means that, regardless of what may be permissible under state law, Section 330 grantees and look-alikes cannot distribute or prescribe medical marijuana to patients.  Health centers also must undertake a risk assessment when determining whether physicians can sign medical marijuana verification forms, certify the existence of a medical condition that would permit a patient to obtain medical marijuana, or even speak freely to their patients about medical marijuana. 

This webinar will provide an overview of the federal Controlled Substances Act and how it deviates from state laws that legalize medical marijuana at the state level. The webinar will also cover where the line is drawn from an enforcement perspective: will courts consider actions such as verification or certification akin to aiding and abetting? Finally, the webinar will offer some potential solutions whereby physicians can “recommend” medical marijuana under free speech protections between a doctor and patient. 

The presenters also will provide examples of recent state law changes and upcoming ballot initiatives that may cause patients to question health centers about their ability to prescribe medial marijuana.
