COVID-19 Vaccine Compliance and Risk Management

Health centers are essential partners in the successful distribution of COVID-19 vaccines across the country. From rural to urban, large to small, health centers everywhere are playing a crucial role in vaccine administration. As health centers react to state and local distribution plans, they are also busy standing up their own vaccine distribution programs. On an almost daily basis, health centers are responding to new information about their role in distribution to individuals in their communities (both patients and non-patients) and simultaneously determining how to mandate or otherwise strongly encourage staff members to get vaccinated. 

From 330 scope of project considerations and malpractice liability to labor and employment law issues, health centers must evaluate the compliance and risk management considerations associated with vaccination of both patients and staff. In this workshop series, we will focus on health center compliance and risk management considerations associated with the COVID-19 vaccine and how health centers can establish their own distribution plans while mitigating the relevant risks associated with vaccinating patients and staff. Presenters will include strategies for developing compliance and risk management best practices around vaccine distribution to patients and staff.

Learning Objectives

After this training, you will be able to:

Day 1:  Ongoing Compliance and Risk Management Considerations Related to COVID-19 Vaccination of Patients (and Non-Patients)

  • Discuss emerging risks related to the COVID-19 vaccination during your organization's COVID-19 response
  • Understand how to ensure COVID-19 vaccine administration is within the health center’s Section 330 federal scope of project
  • Discuss liability risks associated with administering the COVID-19 vaccines
  • Identify liability protections for employees, contractors, and volunteers under the FTCA program, the PREP Act, and other avenues of liability protection
  • Evaluate risk management protective measures in providing the vaccine to patients, including documentation, patient education, and the use of informed consents

Day 2: Employment Considerations for Vaccine Policies for Staff

  • Evaluate employment law considerations related to decisions to strongly encourage or mandate the vaccine when staff are reluctant to receive the vaccine and or plan to refuse the vaccine
  • Understand the federal legal framework for employment-related risk in establishing vaccine policies including ensuring compliance with the Americans with Disabilities Act, Title VII of the Civil Rights Act, the Genetic Non-Discrimination Act, Pregnancy Discrimination Act, National Labor Relations Act, and the Occupational Safety and Health Act
  • Discuss labor considerations when the health center’s workforce is unionized
  • Discuss legal considerations when limiting employee speech on vaccines during and after work hours and on social media
  • Evaluate workers compensation considerations
  • Identify strategies to limit employment-related risk for your health center providers when providing COVID-19 vaccines

As Partner and Compliance Counsel with the firm’s health law practice group, Dianne advises health centers on implementing effective compliance programs and on addressing top compliance risk areas. Dianne counsels health centers and other organizations on developing compliance programs that include the OIG’s seven elements, respond to identified compliance risk areas, and reflect the organization’s culture.  Dianne also advises health centers and other organizations on patient privacy and confidentiality, including the HIPAA Privacy Rule and 42 CFR Part 2.  She has experience responding to privacy and security incidents, including determining whether there has been a breach, notifying patients and the government, and creating corrective action plans. Cancellation/Transfer Policy

All cancellation or transfer requests must be received in writing at learning@ftlf.com. Requests for refunds or transfers for in-person events will be granted according to the following schedule:

  • 30 or more days prior to the event, requests for a full refund or a transfer without a fee will be granted.
  • Between 11 to 29 days prior to the event, requests for cancellations will be granted a 50% refund and requests for transfers will be granted, space permitting and subject to a transfer fee.
  • Within 10 days of the event start date, no requests for refunds or credits will be granted. At FTLF's discretion, late transfers may be granted, space permitting and subject to a transfer fee.
