In developing substance use disorder services in response to the opioid epidemic, many health centers are uncertain whether they must comply with the federal substance use disorder confidentiality regulations at 42 CFR Part 2 (“Part 2”). This uncertainty occurs because whether Part 2 applies depends entirely upon how a health center provides substance use disorder services and whether they have received Part 2 protected records from another organization.

Health centers must regularly review their model for providing substance use disorder services to determine whether (and where in their health center) Part 2 applies.
